Terms and Conditions
The terms governing the use of the Invertir en el Patio platform.
1. Acceptance of Terms
By accessing and using the Invertir en el Patio platform ("the Platform"), you agree to be bound by these Terms and Conditions of Service. If you do not agree with any of these terms, you must not use the Platform.
Continued use of the Platform after the posting of changes constitutes your acceptance of such changes.
2. Service Description
Invertir en el Patio is a verification, coordination, and remote execution platform for real estate-related services in the Dominican Republic. We are NOT a real estate agency, law firm, or surveying firm.
We do not buy, sell, or broker properties. We do not offer legal advice or guarantee specific outcomes in real estate transactions.
Our services include, but are not limited to: parcel diagnostics, land verification reports, technical visit coordination, purchase supervision, and survey coordination.
3. User Accounts
To access certain services, you must create an account using a valid email address. Authentication is performed via OTP (One-Time Password) code sent to your email.
Each person must maintain only one account. Creating multiple accounts is not permitted. You are responsible for maintaining the security of your account and all activities that occur under it.
You must notify us immediately if you suspect any unauthorized use of your account.
4. Services and Payments
Service prices are published on the Platform and broken down transparently. The final price may vary depending on location, complexity, and specific service type.
Payments for executed services are final. Once a service has been initiated and executed, the payment is non-refundable.
Continuity Credit Policy: If you contract a service and subsequently need a higher-scope service on the same property, the amount paid for the previous service is applied as credit to the new service within the validity period. Credits: (a) apply only to the same property, (b) are not refundable in cash, (c) are not transferable to other persons or properties, and (d) are subject to the established validity period.
5. Partner Network
Invertir en el Patio maintains a network of verified professionals ("Partners") that includes lawyers, surveyors, engineers, and field technicians in the Dominican Republic.
Partners operate under the Platform's quality standards, but they are independent professionals. Invertir en el Patio coordinates services but does not directly employ Partners.
We continuously evaluate and monitor our Partners. If a Partner does not meet our standards, they are removed from the network.
6. Limitation of Liability
Invertir en el Patio provides information, verification, and coordination. We do not offer legal guarantees on the outcome of real estate transactions.
We are not responsible for: (a) delays caused by government entities (Title Registry, Cadastre, courts), (b) Partner availability in remote or hard-to-access areas, (c) outcomes that depend on decisions by third parties or government entities, (d) incorrect information provided by the user or by public records.
Our maximum liability is limited to the amount paid for the specific service in question.
7. Intellectual Property
All content on the Platform, including text, graphics, logos, icons, images, reports, documentation, and software, is the property of Invertir en el Patio or its licensors and is protected by applicable intellectual property laws.
Reports and documentation generated as part of our services are delivered to the client for personal use. They may not be reproduced, distributed, or used commercially without express authorization.
8. Privacy
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms and Conditions. We recommend that you read it carefully.
By using the Platform, you consent to the processing of your data in accordance with our Privacy Policy.
9. Anti-Fraud Database
Invertir en el Patio maintains a confidential database of individuals, companies, properties, and documents associated with real estate fraud in the Dominican Republic and the region.
All cases we receive are automatically checked against this database. This is a protective measure for our clients and does not imply any accusation.
The database is strictly confidential, for internal use, and is never published or shared with third parties outside the Platform.
10. Dispute Resolution
These Terms are governed by the laws of the Dominican Republic.
Any dispute arising in connection with these Terms or the use of the Platform shall first be resolved through direct negotiation between the parties. If an agreement is not reached within thirty (30) days, the dispute shall be submitted to arbitration in accordance with the rules of the Alternative Dispute Resolution Center (CRC) of the Chamber of Commerce and Production of Santo Domingo.
The courts of the Dominican Republic shall have exclusive jurisdiction for any proceedings that cannot be submitted to arbitration.
11. Modifications
Invertir en el Patio reserves the right to modify these Terms at any time. Material changes will be notified to registered users by email at least fifteen (15) days in advance.
The current version of these Terms will always be available on the Platform. Continued use after the changes take effect constitutes acceptance thereof.
